Why It Can Change the Closing Process

 

Not every Massachusetts property moves through the closing process the same way. The Commonwealth actually maintains two systems for real estate ownership: recorded land, which represents the large majority of properties, and registered land, which falls under the jurisdiction of the Massachusetts Land Court. For most buyers and sellers, that distinction may never come up in conversation, but behind the scenes it can have a real impact on how a transaction is handled and what may be required before a property can successfully close.

Why Registered Land Deserves a Closer Look

With recorded land, deeds and other documents are filed with the appropriate Registry of Deeds. Registered land is different. Ownership is governed by a Certificate of Title and comes with additional Land Court requirements, which means certain documents, title issues or unusual circumstances may need extra review before a transaction can move forward.

That distinction is especially timely this year because the Massachusetts Land Court has been updating some of its guidance for registered land. Effective July 31, 2026, revised requirements were issued concerning acknowledgments — the formal notarization required for documents such as deeds, certain purchase and sale agreements, mortgage assignments and powers of attorney. Additional guidance took effect September 1 involving certain properties being withdrawn from the registered land system. While these changes are largely procedural, they’re a good reminder that registered land transactions can come with requirements that aren’t always obvious at the beginning of a deal.

Why This Matters Before Closing

Buyers and sellers certainly don’t need to become experts in Massachusetts land registration, but identifying registered land and potential title issues early can make a significant difference in keeping a transaction on track. A missing acknowledgment, an improperly executed document, an issue involving a deceased owner, a power of attorney or another title complication can require additional steps when registered land is involved. When those issues are discovered early, the closing team has time to address them. When they’re discovered a few days before closing, they can quickly become an unnecessary source of stress for buyers, sellers, agents and lenders alike.
